Warranty Claim Conditions
- Products manufactured by Invicta are warranted to be free from defects in workmanship and materials under normal conditions of use and service.
- The warranty is effective from the date of purchase by the user (original purchaser). This limited warranty covers material defects in materials, workmanship and performance.
- This warranty applies only to the original purchaser and is limited in time to the unexpired portion of the warranty period. If the item is given away or resold, the user must claim the warranty through the original purchaser, who requires the original order information/proof of purchase.
- Products that have been repaired or replaced within the warranty period will not receive an extended warranty. Instead, repaired/replaced products will be subject to the original warranty period issued at the time of initial purchase.
- The user agrees to make the product accessible under warranty to SPB or its authorised representative for inspection at reasonable hours and intervals, and must provide the part number, serial number, a description of the defect, and proof of purchase.
- The warranty shall be voided if the product becomes unserviceable due to: fire, freezing, abuse, neglect, repair, alteration or modification or any act of God.
- The installation of the product must be performed by suitably qualified technicians and in accordance with proven, acceptable practices; otherwise, the warranty will be voided.
Making A Claim
- Contact the original point of purchase for instructions.
- Supply the part number, serial number, detailed description of the defect, and proof of purchase. Your claim will not proceed without this information.
- Request a return authorisation. No returns will be credited without authorisation.
- In the case of a returned product, it must be packed with sufficient padding and in the appropriate cartons to eliminate the risk of damage in transit.
- The product must only be returned in compliance with the transport and packaging regulations ruling at that time. Failure to do this may result in the carrier refusing the shipment.
- Incorrectly identifying the content of such packages is illegal, and the shipment could possibly be subject to substantial fines and confiscation of the goods in accordance with Federal and State laws.
- SPB has the option to credit or replace products deemed defective and under warranty.
- Cost of travel, labour, installation, and transportation shall be borne by the purchaser.
The above warranty is in lieu of and not limited to all other remedies, including negligence and breach of contract.
The Competition and Consumer Act 2010 and the Australian Consumer Law may guarantee certain conditions, warranties and undertakings in relation to Goods. To the extent they apply, these guarantees cannot be modified nor excluded by contract, and this warranty document does not purport to modify or exclude any conditions, warranties, guarantees and undertakings under the Australian Consumer Law.
Handling
PLEASE NOTE: There will be a 30-day window after receipt of the product during which the consignee may file a claim for components damaged or lost in transit. After 30 days, SPB will waive liability, and the user will be held responsible for any damage, lost items, or negligence during shipment, as well as the cost of extended storage.
EXCHANGES: During the warranty period after purchase, if the user encounters any defects in workmanship and materials in normal application, such as defects and/or failures due to manufacturing or material reasons, the user is required to notify SPB of the product defects through the purchasing platform/official website customer service email address ([email protected]), and ship the product to SPB’s technical support team to detect the cause of the failure, if needed.
Based on the test results, SPB will provide customers with a free exchange if the defect is due to material, workmanship and performance issues.
Exclusions and Limitations
This contractual warranty does not cover failures due to improper operation, product modification, installation, conversion or addition, supplementation, operation, natural elements (weather), excessive or insufficient energy supply, chemicals, solid influences, or intentional damage. If SPB determines that a problem with the product is not due to a manufacturing defect in SPB’s workmanship or materials, or does not qualify for warranty repair, the user will be responsible for all costs associated with repairing, replacing and shipping the product.
SPB will not be responsible for costs associated with installation/dismantling, testing of the electrical system, loss of time, or other incidental damages.
Warranty claims relating to defects caused by any of the following factors are not covered by the contractual warranty:
- improper use or non-observance of installation, commissioning, operation or maintenance instructions
(i.e. non-compliance with operation and installation manuals)
- unauthorized modifications, alterations or attempted repairs.
- vandalism, external influences and/or damage caused by persons/animals
- use in unsuitable environments, including any environment that results in excessive wear or accumulation of dirt, dust or debris within the system, unsafe environments
- Inadequate ventilation
- Installation in a corrosive environment
- Failure to comply with applicable safety standards and regulations
- Damage during transportation or storage
- Force majeure, including but not limited to: fire, flood, earthquake, storm damage, overvoltage and lightning strike
- Exposure to fire, water, snow, moisture or liquid ingress (except for environmental conditions that your product is specifically designed to withstand, as indicated by the applicable specifications for your product)
Limitation of Liability
In no event shall SPB or suppliers be liable for any loss of use, business interruption, lost profits, loss of data, or
indirect, special, incidental or consequential damages of any kind, regardless of the form of action, whether in contract, tort (including negligence), strict liability or otherwise, even if SPB has been advised of the possibility of such damages.
If applicable law does not allow the exclusion of implied warranties, liability limitations,
the duration of implied warranties, or the limitation or exclusion of incidental or consequential damages, then the above limitations or exclusions only apply within the scope permitted by applicable law.
